TERMS AND CONDITIONS 1. Payment Terms All leads that are purchased are exclusive of VAT. There are no Set-up charges and no additional charge for data cleansing, you just buy at the price you purchase. Once the lead is downloaded you will be invoiced 30 days from the date of purchase. Your account will terminate if payment is not made in accordance with these terms. 2. Overdue Payment terms All overdue accounts will carry interest at 2% per calendar month until payment. Payment terms may be modified subject to status. All forecasts for ‘deliverables’, including appointments and sales leads, are estimated in good faith using experience and judgement and do not constitute a guaranteed sale. 3. Registration Registration is simple, just register your details online we then receive an email to us and within 24 hours set your account with a credit limit to then purchase as many leads within your allocated limit. 4. Handset criteria Only companies that have 2 + handsets as a business will be appointed and made live online. If the company has 2 or 3 handsets at the business then the ARPU (AVERGE REVENUE PER USER) has to be no lower than £35 per user to be classed as a viable appointment. 5. Notice for a viable lead In the event that a lead purchased from leadzonline is not viable we must be contacted within 48 hours of the booked meeting date and made aware of the issue in which you feel the appointment is not viable otherwise you will be invoiced for the appointment and therefore will be eligible to pay for that lead. In the event that the lead is as the customer says not viable then we Leadzonline ltd will give you a free credit for the same amount that you purchased the original lead for so you can go back on the website and purchase another lead free of charge, there will be no refund given back. Once you purchase a lead and attend the meeting you will be invoiced for that lead and are obliged to pay. We always ask customers who purchase leads to contact the appointment 72 to 48 hours before the meeting date to confirm the meeting. If you purchase a lead from the website and you re-arrange the meeting and the customer cancels you will still be invoiced for that lead in accordance, as the appointment clearly was set for a date and time already. 6. Procedure of Cancellations In the event of viable cancellation of a lead bought from the website, the procedure for leadzonline is as follows: You must make contact with your account manager at leadzonline within 48 hours of the appointment date. · We then contact the customer directly to clarify the reason for cancelation · We then try to re book the lead free of charge for you · If we can’t for any reason re book the lead we then replace the lead free of charge for you with a lead that is of the same value that you purchased the original lead for. 7. Contract for Purchase of leads Leadzonline ltd does not tie you into a contract which means you can purchase 1 lead a month or 1 lead a year. However if you feel that you require a block of leads every month and there is not enough online for you to do this then you can contact your account manager and discuss a bespoke package for your business. 8. Force Majeure Leadzonline ltd and the client shall be released from their respective obligations in the event of national emergency, war, prohibitive government regulation or if any other cause beyond the reasonable control of the parties or either of them renders the performance of this agreement impossible, whereupon all money due under this agreement shall be due and paid immediately 9. Professional Standards Leadzonline Ltd is a Telephone Preference Service subscriber. All TPS barred numbers will be suppressed. Leadzonline Ltd abides by all relevant rulings and the code of conduct adopted by the Direct Marketing Association. (www.dma.org.uk) 10. Confidentiality Leadzonline Ltd shall, during and after a client’s tenure, take all reasonable steps to ensure that all proprietary and confidential information supplied by a client to Leadzonline Ltd, its employees, agents or subcontractors pursuant to the supply of Telemarketing is not disclosed to any third party, except to the extent necessary for Leadzonline Ltd to deliver its services by agreement. 11. Ownership Ownership and all copyright of ideas, methodologies and manner of presentation (including briefs, proposals and reports) are the property of Leadzonline Ltd. 12. Call recording For quality control purposes, all calls made to or from the Leadzonline Ltd are digitally recorded and an archive of approximately eight week’s worth of calls will be held securely on-site. 13. Proper Law This agreement shall be governed by English Law in every particular including formation and interpretation and shall be deemed to have been made in England. 14. Soliciting Staff The Client shall not, for a period of 12 months following cessation of this agreement, cause, encourage or assist any of Leadzonline Ltd employees to leave its services or to do anything which if done by The Client would be a breach of this agreement.
